Accepting these terms
By using this website, or by accepting a quote from us, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the website or our services. If you accept on behalf of a business, you confirm that you have the authority to bind it.
Using this website
All content on this website, including the text, graphics, the Pixeri logo and the Pixi mascot, belongs to Pixeri Solutions or is used with permission. You may view it for personal use, but you may not copy, reproduce or reuse it without our written permission.
Client work in our portfolio is shown as examples of what we do. The brands, logos and trademarks in it belong to their respective owners.
Please don’t misuse the website, for example by trying to gain unauthorised access, uploading malicious code, sending spam through our forms or using it for anything unlawful.
We try to keep the information on this website accurate and up to date, but it is general information. Prices, scope and timelines are only confirmed in a written quote.
Quotes and projects
- Every project starts with a written quote or proposal that sets out the scope, deliverables, price and timeline. Together with these terms, it forms our agreement. If the quote and these terms differ, the quote applies.
- Quotes are valid for the period stated on them.
- Work begins once you have accepted the quote in writing (email, WhatsApp or our client portal is fine) and paid any deposit the quote asks for.
- Timelines depend on receiving your content, feedback and approvals when they are needed. Delays on your side may move the delivery date.
- Any revisions included in the price are set out in the quote. Extra revisions, or work outside the agreed scope, will be quoted before we do it.
Your responsibilities
- Give us accurate information, content and feedback on time.
- Make sure you own, or have permission to use, everything you send us, such as text, photos, logos and fonts. You are responsible for any claim arising from material you supply.
- Check proofs and final files carefully before you approve them. Once you approve artwork for print or a website for launch, we aren’t responsible for errors in what you approved.
- Keep the passwords and account details for your website, hosting, email and client portal safe.
- Bear in mind that colours can look different on different screens, in print and between printers.
Payment
- Invoices are in South African Rand and are payable by the due date shown on them, using the payment details on the invoice.
- If an invoice is overdue, we may pause work, or suspend hosting, email or other services, after letting you know.
- Costs we pay on your behalf, such as stock images, fonts, plugins, printing or domain fees, are charged as set out in the quote.
- We may review prices for recurring services such as hosting from time to time, and will give you reasonable notice before a new price applies.
Ownership and portfolio use
- Once you have paid in full, you own the final approved deliverables we create specifically for you, such as your logo, artwork and website design, unless the quote says otherwise. Until then, we keep all rights in the work.
- Concepts and drafts you didn’t choose remain ours. Editable working files are only included if the quote says so.
- Third-party items such as stock images, fonts, plugins and themes remain subject to their own licences. We’ll tell you if you need to buy or renew a licence.
- Tools, code and methods we already had, or that we use across many projects, remain ours. You receive the right to use them as part of your deliverable.
- We may show finished work in our portfolio and on social media once it is public. If you’d rather we didn’t, let us know in writing.
Hosting, domains and email
- Hosting, email and other recurring services run for the billing period on your quote or invoice, and continue for further periods until either of us cancels.
- Domain names are subject to the rules of the registry that manages them, such as ZACR for .co.za domains. Renewal fees must be paid before the expiry date. A domain that expires can be lost, and we can’t guarantee it can be recovered.
- You are responsible for the content on your website and in your email, and for using our services lawfully. We may suspend a service that is used for spam, malware or illegal content, or that puts our servers or other clients at risk.
- We take reasonable steps to keep services available and backed up, but we can’t guarantee uninterrupted service. Planned maintenance and events outside our control can cause downtime, so please keep your own copies of important content.
- If you move to another provider, we’ll help with what is reasonably needed to transfer your website, domain and email once your account is paid up.
Cancellation
- You may cancel a project by letting us know in writing. You pay for work completed and costs we have incurred up to the date of cancellation.
- To cancel a recurring service, let us know before the next billing period starts.
- We may end an agreement if you breach these terms and don’t put it right after we have asked you to, or if an account stays unpaid.
- Nothing in these terms limits any rights you may have under the Consumer Protection Act 68 of 2008 or ECTA, including any cooling-off rights that apply to you.
Our liability
- We do our work with reasonable care and skill.
- As far as the law allows, we aren’t liable for indirect or consequential loss, such as lost profits, data or business, and our total liability for any claim is limited to the amount you paid us for the project or service concerned.
- We aren’t responsible for failures of third-party services we rely on, such as hosting infrastructure, domain registries, Google or WhatsApp, or for events outside our reasonable control, such as load-shedding, network outages or natural disasters.
- Nothing in these terms excludes liability for gross negligence or wilful misconduct, or any liability that can’t be limited by law.
General
- Confidentiality. We keep your business information confidential and use it only for your work. How we handle personal information is explained in ourPrivacy Policy.
- Indemnity. As far as the law allows, you indemnify us against claims arising from material you supply or from your breach of these terms.
- Severability. If any part of these terms is found to be unenforceable, the rest still applies.
- No waiver. If we don’t enforce a term straight away, we can still enforce it later.
Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. If a dispute arises, please contact us first so we can try to resolve it in good faith. If we can’t, either of us may refer it to a South African court with jurisdiction.
Changes to these terms
We may update these terms from time to time. The version on this page applies from the date shown at the top. Changes don’t affect a quote you have already accepted, unless we both agree.
